Various enforcement agencies can conduct arrests, including the Singapore Police Force (“SPF”), the Immigration and Checkpoints Authority (“ICA”), the Central Narcotics Bureau (“CNB”) and the Inland Revenue Authority of Singapore (“IRAS”). Arrests can be conducted without a warrant where the relevant authority has a reasonable suspicion that a party has committed a serious arrestable offence under the First Schedule of the Criminal Procedure Code 2010. An arrested party can only be detained for up to 48 hours, unless the Court grants permission for an extension of the detention period.
You will be allowed to consult a lawyer within a reasonable time after your arrest. What is a “reasonable time” will depend on the circumstances of your arrest and the ongoing investigations – there is no specified time frame on what is “reasonable”. In the course of the investigations, the police may also interview you to record your account of the facts and circumstances of the case.
If you are charged with an offence, you may be asked to provide a signed statement referred to as a Cautioned Statement. This is your opportunity to give your defence or an explanation of the events surrounding your arrest, and any other information you believe is significant.
You will also be asked to appear in the Criminal Mentions Court to be formally charged at a court mention. The charge will be read out to you and you will have the opportunity to respond to it. This means that you can inform the Court whether you wish to plead guilty or not guilty. In the appropriate circumstances, the Court may offer bail.
When the Court offers bail, you will be released from custody on the condition that you will be present at court proceedings and investigations as required, and comply with any other court directions. Additionally, the Court will determine a “bail amount” to be paid by your bailor as a form of security. The bail amount will depend on multiple factors, such as the nature of the charges and the likelihood of compliance with the bail conditions.
If the Court is satisfied that you have complied with all the bail conditions, the bail amount will be returned to the bailor.
However, it is important to note that not all offences are bailable. If the offence that you were suspected of committing is a non-bailable offence, you will be held in remand pending further investigations and/or directions from the Court.
