Guiding You Through the Complexities of Coroner’s Inquiries
In Singapore certain types of deaths are required by law to be investigated by the police and reported to the Coroner, who is a judicial officer of the Singapore Courts.
This includes, among other things, deaths in Singapore which were unnatural or violent, or which resulted from / is suspected to have resulted from an accident, an unlawful act or omission, where the manner or cause of death is unknown, and deaths which occurred under suspicious circumstances. A death in Singapore which occurred directly or indirectly as a result of any medical treatment or care is also a reportable death.
The police will report their findings to the Coroner, and the Coroner will conduct what is called a Coroner’s Inquiry (“CI”). The CI is a fact finding process conducted by the Coroner, who has the power to give directions concerning such investigations in reportable deaths. The powers include the power to summon and compel the attendance of witnesses or the production of documents for the CI.
The purpose of the CI is for the Coroner to ascertain the identity of the Deceased (e.g. in cases where the identity is unknown), and the circumstances leading to the death (i.e. how, when and where the Deceased passed away). It is not a fault finding process, nor is it a criminal trial where a person is prosecuted of criminal offences. The Coroner cannot determine the issue of criminal liability.
The CI will lead to an inquiry hearing, which is held in open Court. Persons who qualify as a properly interested person, such as the spouse / next-of-kin / personal representative (the Executor or Administrator of the Deceased’s Estate), may attend and examine witnesses at the CI.
At the conclusion of the CI, the Coroner will record his findings, e.g. suicide or misadventure, and forward a copy of the certificate setting out the cause of death as found at the CI, to the Registrar of Births and Deaths.
